    Definitions 

    “Airport Rules and Regulations” shall mean the Airport Rules and Regulations for the Oakland San Francisco Bay Airport contained in Chapter 8.01 of the Port of Oakland Administrative Code (POAC). 

    "Ground Transportation Permit" shall have the same meaning as "Airport Permit."

    "Ground Transportation Services" shall mean any of the services provided by a Charter Party Carrier, Passenger Stage Carrier, Courtesy Vehicle, a Passenger Stage Sub Carrier, or a Limousine at, to, from, or on behalf of the Airport.

    "Ground Transportation Vehicle" shall mean a Vehicle operated with an Airport Permit issued to a Qualified Operator engaged in providing Ground Transportation Services at or to and from the Airport.

    Per Airport Rules and Regulations “Limousine” shall mean a sedan or sport utility vehicle, of either standard or extended length, with a seating capacity of not more than ten (10) passengers, including the driver, used in the transportation of passengers for hire on a prearranged basis at or to and from the Airport, as defined in CPUC General Order 157-E, Section 2.05 (as the applicable CPUC General Order and associated definition may be amended or superseded from time to time).

    Unless otherwise apparent from their context, all other capitalized terms shall have the same meanings set forth in the Airport Rules and Regulations.

    Overview

    Permits will not be issued for incomplete applications.

    Please note that every driver providing Ground Transportation Services shall be affiliated with a company that is duly permitted by the Airport under the Airport Rules and Regulations. Regardless of the contractual relationship between the individual driver and the company, the company will be responsible for all fees and charges incurred by drivers and the company will be billed accordingly.

    Nothing in this Permit shall allow for Ground Transportation Services using fully autonomous Vehicles. All Ground Transportation Services must be provided in a safe manner, in accordance with the Airport Rules and Regulations.

     

  • Compliance With Laws 

    By accepting an Oakland San Francisco Bay Airport Operating Permit, the Permit Holder acknowledges and agrees to comply (and ensure that all of its Drivers comply) with all applicable federal, state, and local laws, ordinances, rules, regulations, and directives, as they may be amended from time to time (collectively, “Laws”), including (without limitation): the Airport Rules and Regulations; Airport Operating Directives from the Director, Assistant Director, or Landside Operations Manager; all oral and/or written instructions applicable to Ground Transportation Services given by the Landside Operations Manager or a designated Port representative;  to the fullest extent applicable Laws relating to public safety, safe driving practices, seat belts, child seats, and drug testing; the Americans with Disabilities Act (42 USC § 12101, et seq.), Section 504 of the Rehabilitation Act of 1973 (29 USC § 701, et seq.), and Title 24 of the California Code of Regulations;

  • Credit Card on File

    In accordance with Section 8.01.100 of the Airport Rules and Regulations, Operators are required provide valid credit card information and maintain credit card information via GateKeeper / AdComp so that such credit cards may be used by the Airport to pay for all amounts owed under the Airport Rules and Regulations, including payment of transponder and/or trip fees. 

    Automatic Suspension for Nonpayment or Invalid Payment Method

    “A GT Permit shall be automatically suspended if the Permit Holder fails to maintain a valid credit card or other Port-approved payment method on file with the Landside Operations Office, or if the Permit Holder has an outstanding balance owed to the Port for fees, charges, or penalties assessed under the POAC. Suspension shall remain in effect until the Permit Holder provides a valid payment method and pays all outstanding sums owed. Any operation at the Airport during a period of suspension shall constitute a violation subject to enforcement under Section 8.01.

    If the suspended Permit Holder is a CPUC-licensed carrier (TCP or PSC), the Port shall report the noncompliance to the California Public Utilities Commission. If the suspended Permit Holder is a City of Oakland permitted Taxicab, the Port shall report the noncompliance to the Oakland Taxi Detail.”  

  • AVI Transponders

    (All vehicles must have a valid OAK Transponder)AVI Transponder Fee = Any vehicle without a valid OAK Transponder will be assessed a replacement transponder fee of $50.00 at the time of vehicle inspection, this will be charged to the payment portal of the operator. Removing an AVI transponder for any reason (this includes windshield replacements), invalidates the AVI and operators are subject to citation. AVI transponders are non-transferrable and once removed, cannot be reused or reapplied to the windshield and must be returned in the event of removal or vehicle sale.

  • Security Deposit for Airport Permits 

    Upon the issuance of an Airport Permit, each Permit Holder (other than a Partially Exempt Qualified Operator or Exempt Qualified Operator) shall pay and maintain a security deposit, to be held by the Port for the account of the Permit Holder. The Port will not pay interest on the security deposit. The Port may deduct any delinquent amount payable to the Port by the Permit Holder from the amount in the Permit Holder’s security deposit account. Should any amount be deducted from its security deposit account, such Permit Holder shall replenish the security deposit account to the required amount within ten (10) days of notice from the Port of such deduction. Upon the second draw on any Permit Holder’s security deposit account within any twelve (12) consecutive months, the required amount to be deposited with the Permit Holder’s security deposit account shall increase to two (2) times the standard required security deposit amount. The standard required Airport Permit Security Deposit amount shall be in the amount set forth in POAC Appendix C-3 (Airport Master Fee Schedule).

     

     

  • Vehicle Condition and Appearance

    The exterior of each Ground Transportation Vehicle and Taxicab shall be maintained in a damage-free and clean condition. The interior of each Ground Transportation Vehicle and Taxicab shall be maintained in a damage-free and clean condition, free from litter, foreign matter and offensive odors.

    Each Ground Transportation Vehicle and Taxicab shall be mechanically and structurally sound and maintained to provide for the safety of the public in accordance with City ordinances, state laws and the Rules and Regulations, including the City Taxi Ordinance for Taxicabs. Ground Transportation Vehicles or Taxicabs with damage, including tires that fail to comply with California Highway Patrol tread requirements, or any non-working parts, shall not pick up passengers at the Airport and may be barred from the Airport until repaired.

  • Ground Transportation Permitting 


    The Airport Permit shall at all times remain the property of the Port and is subject to suspension, cancellation, termination, expiration, or renewal by the Port in accordance with the Airport Rules and Regulations.  

    By completing this application and accepting the Airport issued permits, the applicant acknowledges their responsibility for paying all fees. The applicable applicant hereby certifies that the information in this application is accurate and that the signatory below is fully legally authorized to sign on behalf of the applicant. The applicant further agrees that its company and its drivers will comply with all applicable federal, state, and local laws, ordinances, rules, regulations, and directives, which may be amended from time to time, including, without limitation the Airport Rules and Regulations, Airport Operating Directives from the Director, his/her designee, all oral and/or written instructions applicable to Ground Transportation Services given by the Landside Operations Manager or or his/her designee, and all laws pertaining to public safety, safe driving practices, seat belts, child seats, drug testing, and accommodation of individuals with disabilities. The applicant agrees to notify the Airport immediately in writing of any changes to the materials or information submitted with this application, and to the prompt return of Permits and Transponders in the case of replacement windshields, vehicle removal from fleet or as required by Airport regulations.

     

     
    Renewal

    Airport Permits may be renewed at the end of the Permit Period provided that  
     (i) the Permit Holder has maintained current and accurate vehicle and driver information with the Landside Operations Office,   
    (ii) no outstanding violations, suspensions, or unresolved complaints are on record for the Permit Holder during the prior Permit Period, and   
    (iii) all fees have been timely paid, and no balances remain owed. Automatic renewal shall be at the discretion of the Landside Operations Manager, and the Port reserves the right to require full application review if any compliance issue is identified.”  
    iv. Renewal application has been submitted. Renewal applications must include evidence of compliance with Port operating procedures during the prior Permit Period.

    Failure to submit current documents will result in an incomplete application.

    Permit holders are also required to maintain accurate vehicle information in the GateKeeper Vendor Portal as part of the terms of the permit.

  • INSURANCE REQUIREMENTS

  • CERTIFICATES OF INSURANCE MUST SHOW THE FOLLOWING:

    1. That the City of Oakland, a municipal corporation, acting by and through its Board of Port Commissioners, "the Port", its commissioners, agents, contractors, employees, and officers are additional insureds on the Commercial General Liability policy (if required above) and the Business Automobile Liability policy (a copy of the additional insured endorsement must be attached to the certificate and must include the above additional insureds or provide blanket coverage);

    2. That all insurance is primary and non-contributory with insurance carried by the Port of Oakland;

    3. That the Commercial General Liability (if required above) and Automobile Liability Insurance policies contain cross liability or separation of insured provisions;

    4. That the Port of Oakland Risk Transfer Office shall receive 30-days advance written notice of cancellation, non-renewal, or material reduction in coverage;

    5. That all insurance policies (as required above) provide a waiver of subrogation in favor of the City of Oakland, a municipal corporation, acting by and through its Board of Port Commissioners, "the Port" its commissioners, agents, employees, and officers (a copy of the waiver of subrogation endorsements must be attached to the certificate

    6. All autos scheduled under the policy should be listed on the certificate or attached thereto. Operations or occupancy may be interrupted without proper evidence of insurance.     Provide a statement that your company is exempt from providing Workers Compensation and does not have any Employees at this time, and if you should hire any in the future you will immediately notify the Ground Transportation Unit and submit the required copy of your Worker's Compensation Certificate with any required Endorsement(s) to the Ground Transportation Department and the Port of Oakland's Risk Management Insurance Section.
